Description

The pervasive influence of AI, notably exemplified by ChatGPT, presents multifaceted challenges across industries, including law. This two-part explorative session will delve into AI and ChatGPT’s influence, from both a non-contentious and a contentious perspective.

Whereas Part I focussed on the non-contentious perspective, Part II will hone in on dispute resolution, including AI and ChatGPT’s role in both the courts and arbitration. Key areas of discussion from our panel of experts will encompass the legal framework and jurisprudence on the use of AI and ChatGPT, the differences between the use of intelligent software in litigation and arbitration and the key benefits and pitfalls of AI, including falsified evidence, data protection and ethical considerations (such as the environmental impact it may have).

Sara Khalil

Schoenherr, Austria

Sara is a Counsel based in Schoenherr’s Vienna office and specialises in commercial litigation. Recently, Sara has been focusing on representation of clients in numerous data protection litigation proceedings in civil courts. She also advises on contract drafting and termination including potential compensation, indemnity and other termination claims.

Huib SCHRAMA

Rutgers & Posch, the Netherlands

In the Dispute Resolution practice of Rutgers & Posch, Huib advises and litigates on corporate disputes and commercial contracts. He represents businesses, investors, entrepreneurs and financiers in various industries, including private equity, real estate, tech and finance. He litigates on international disputes, distribution agreements, M&A contracts and loan agreements, and regularly advises (supervisory) board members. He has broad experience with class actions and cartel damages.

Huib has extensive knowledge of contract law, liability law, private international law, attachment- and enforcement law, and corporate law. He has completed two specialist educations at Grotius Academy with honours: Enterprise & Liability (2015) and Company & Business Law (2017). Huib regularly speaks and publishes. He is a permanent teacher on corporate disputes at the Mandatory Education of the Dutch Bar Association.

Before joining Rutgers & Posch, he worked for international law firm Loyens & Loeff for 12 years. He has extensive international experience and is a member of the IBA and AIJA. In the Netherlands, he is a member of the Association for Trade Law, the Association for Procedural Law and the Corporate Litigation Association. Huib also handles pro bono matters and next to being an attorney-at-law he is active as board member/advisor of several cultural organizations. He is a driving force in several committees of Rutgers & Posch, amongst which the committees on AI & Innovation, on Foreign Affairs and on Education.

Legal 500 (2022 and 2023) ranked him as Next Generation Partner in the field of Commercial Litigation with clients describing him as “excellent, strong on the law, but also very relaxed and easy to deal with. He is a calming presence despite his young age – one to watch” and “a great litigator with a sensible approach and calm demeanour”.

Gretta Walters

Chaffetz Lindsey, United States

Gretta Walters is a Partner at Chaffetz Lindsey in New York. Gretta’s experience as counsel and arbitrator spans a broad range of commercial and investment disputes in domestic and international arbitration and in state and federal courts.  She has worked on matters arising under the ICC, ICDR, AAA, SCC, SMA, LCIA, and UNCITRAL Rules.  Her cases as counsel have included disputes concerning construction/infrastructure projects, energy/oil & gas projects, licensing and distribution agreements, investment agreements, M&A transactions, banking and finance, securities laws, manufacturing and sales contracts, and employee and executive compensation agreements.

Additionally, among other activities, Gretta is Secretary of the NY Branch of Ciarb and on the AAA/ICDR Council and its Subcommittee on Energy. She is also an adjunct professor at New York University Law School, where she teaches international arbitration and co‐coaches the Foreign Direct Investment and Vis International Commercial Arbitration moot court teams.  Gretta regularly speaks at international arbitration-related conferences and co-authored Enforcement of Foreign Arbitral Awards and Judgments in New York (Kluwer 2018).

Gretta’s recent accolades include being selected as one of nine “Most Highly Regarded Future Leaders – Partners” in North America for 2023 in Who’s Who Legal Arbitration, “Up & Coming Counsel” in Chambers USA, “Recommended Lawyer” in Legal500 LatAm, “Rising Star” and “Key Lawyer” for international arbitration in Legal500 USA, and one of 25 “Rising  Star Legal Stars” in Latinvex.

Nathalie WEISS

Nägele Rechtsanwälte GmbH, Liechtenstein

Nathalie is an Attorney at Law registered in the list of Resident European Lawyers in Liechtenstein and also admitted to the Austrian Bar. She studied in Vienna and also worked there as an associate for various medium-sized law firms. Therefore, she has several years of experience in the areas of civil, (commercial) criminal and is specialized in particular in litigation at all instances.

Furthermore, since the beginning of her career, she intensively dealt with the field of “Legal Tech”. Since her admission to the bar 1 year ago, she has been working for Nägele Attorneys at Law in Liechtenstein, which is primarily known for its expertise in the areas of Blockchain/DLT but also CyberSecurity, Artificial Intelligence and also in the areas of Internet, capital markets, telecommunications, business, corporate, employment, contract, and property law.
